Smart contracts in Portugal

Portuguese law offers legal comfort for services that resort to smart contracts. Since 2004, Decree-Law No. 7/2004 has provided a specific clause regarding contracts executed through computers without any human interference. It applies standard contract law principles, including the doctrine of mistake in cases of programming errors or distorted messages. Moreover, self-executing or smart contracts could be allowed by this provision, since it is rooted in the Portuguese general principle which states that contracts are not necessarily subject to a particular form –unless otherwise stated– even though there is no dedicated legal framework for them.1
